GENERAL TERMS AND CONDITIONS OF SALE

1. Acceptance of the General Terms and Conditions of Sale

1.1 The contract entered into between lineacortesia.it and the customer shall be deemed concluded upon acceptance of the order by lineacortesia.it. Such acceptance is considered implicit unless otherwise communicated to the customer in any form. By placing an order in any of the permitted ways, the customer declares to have read all the information provided during the purchase procedure and to fully accept the general and payment conditions set out below.

1.2 Once the online purchase procedure has been completed, the customer is required to print, save an electronic copy and/or otherwise retain these general terms and conditions of sale.

2. Purchase Methods

2.1 The customer may purchase only the products listed in the electronic catalogue at the time the order is submitted, viewable online at (URL) https://www.lineacortesia.it/, as described in the respective product information sheets. It is understood that the accompanying image of a product may not perfectly represent its features and may differ in colour, size, or any accessories shown in the picture. All purchase support information is to be understood as generic informational material and not attributable to the actual characteristics of any single product.

2.2 The correct receipt of the order is confirmed by lineacortesia.it via an email sent to the address provided by the customer, indicating the ‘Customer Order Number’, to be used in any further communication.

2.3 The message includes all the data entered by the customer, who undertakes to verify its accuracy and promptly communicate any corrections, following the methods described below.

2.4 Should an incorrect sales price be generated by the website due to the extensive size of the catalogue and the amount of information it contains, lineacortesia.it will notify the customer via its Customer Service and, upon request by the customer, cancel the order.

2.5 In the event of out-of-stock items — even temporarily — lineacortesia.it may refuse the purchase request by notifying the customer, who may also be informed of any available replacement products. Unless the customer requests to purchase a replacement product, lineacortesia.it will refund any amounts already paid as soon as possible and in any case no later than 14 days from the date on which the order was cancelled.

3. Prices

3.1 All prices published at the time of the order apply. The prices refer to the illustrated items according to their description. We reserve the right to correct errors and modify prices. All prices on the website are shown without VAT (currently 22% in Italy) and exclude shipping costs and — if requested — cash-on-delivery fees.

4. Payment Methods

4.1 PayPal
If paying via PayPal, the customer agrees to make the payment following the instructions sent by lineacortesia.it via email within 10 days of the order. After this deadline, the order will be automatically cancelled. Shipment will occur only after payment has been received.
PayPal is a simple, fast, and secure online payment method that allows you to purchase without entering credit card details. By selecting PayPal, the customer will be redirected to a PayPal page where they will enter their email address and password to complete the payment.

4.2 Advance Bank Transfer
lineacortesia.it will provide the customer with bank details via email. Shipment of the order will occur once the payment has actually been credited to the indicated bank account, which must occur within 10 working days from acceptance of the order. After this deadline, the order will be automatically cancelled. The payment reference must include the order number.

4.3 Cash on Delivery
Payment by Cash on Delivery (subject to an additional fixed fee of €5.00) must be made to the courier at the time of delivery, in cash or with a cashier’s cheque payable to the courier.

5. Delivery Methods and Costs

5.1 lineacortesia.it accepts orders only with delivery within Italian territory.

5.2 For invoicing purposes, the information provided by the customer at the time of the order applies: no changes will be possible after the invoice has been issued. The invoice will be sent to the email address provided by the customer during registration. Invoices cannot be issued after the order has been submitted.

5.3 It is the customer’s exclusive responsibility to carefully check the data entered in the “billing address” field, which cannot be modified once the order has entered the shipping phase. The invoice will be issued to the address provided at the time of purchase and cannot be reissued under a different name or address. No variations to the invoice will be possible.

5.4 If applicable, delivery costs are borne by the customer and explicitly shown at the time the order is placed, unless specific promotions apply.

5.5 Ordered products are delivered as quickly as possible, normally within 2–3 working days from payment confirmation. Due to the large number of items available, in case of urgent guaranteed delivery, it is recommended to request availability confirmation via info@lineacortesia.it. You will receive confirmation of item availability within 24 hours. In case of delays exceeding 30 days from the delivery date communicated by lineacortesia.it, the customer may cancel the order and terminate the contract, with full refund of the amount paid.

5.6 lineacortesia.it is not liable for any direct or indirect damages resulting from delays in shipping and/or delivery.

6. Delivery

6.1 Unless expressly stated by lineacortesia.it Customer Service, delivery is intended at street level (ground floor).

6.2 At the time of delivery by the courier, the customer must check:
– that the number of packages matches what is indicated via email
– that the packaging is intact, undamaged, not wet or altered, including closure materials (adhesive tape or metal straps).
Any damage to the packaging and/or the product must be immediately reported by writing “SUBJECT TO INSPECTION” on the courier’s delivery note. Once the delivery note is signed without reservation, no claims may be made regarding external damage to the packaging or the products. Any issues regarding physical integrity, correspondence or completeness of the products must be reported within 5 days of delivery to the Customer Service at: info@lineacortesia.it.

6.3 In case of unsuccessful delivery, the courier will leave a written notice with instructions to arrange a new delivery. If the second delivery attempt also fails, the courier will return the parcel to lineacortesia.it and the order will be automatically cancelled. In this case, the customer will receive a refund of the amount paid, excluding shipping costs (including return and handling fees).

7. Right of Withdrawal

7.1 The customer may request the return of products, under penalty of forfeiture, within 14 days of receipt by sending an email to: info@lineacortesia.it
Upon receipt of the request, lineacortesia.it Customer Service will email the customer the return authorization number, which must be included in the return form provided. Shipment must occur within 14 days from receipt of the authorization number and must be sent to the registered office of lineacortesia.it. Returns without authorization will not be accepted. It is the customer’s responsibility to organize the shipment and bear the related costs.

7.2 The right of withdrawal applies under the following conditions:
– the product must be returned in its entirety: it is not possible to return only part of the purchased product (e.g. accessories, etc.);
– the product must be intact and fully resellable: it must not have been used, installed, or subjected to any treatment that makes it unsuitable for resale. lineacortesia.it will perform checks to verify integrity and may refuse the return if use or tampering is detected;
– the product must be returned in its original packaging, complete in all its parts (including cases, packaging, documentation, manuals, accessories, etc.). The customer must take all precautions to avoid damage during transportation, packing all items properly. lineacortesia.it recommends placing the product in a second box when possible and writing the return authorization number on it. No labels or tape must be applied directly to the original packaging.
The product travels entirely at the customer’s risk until it reaches the warehouse.

7.3 In case of damage during transport, lineacortesia.it will notify the customer immediately. The product will be made available to the customer and the withdrawal request will be cancelled. lineacortesia.it is not liable for any damage, theft, or loss of goods shipped by the customer.

7.4 If the return procedure is correctly followed, lineacortesia.it will refund the full amount paid via bank transfer to the bank details provided by the customer. The refund procedure will remain suspended until the returned products are received.
Return shipping costs are borne by the customer and may be deducted from the refund amount.

7.5 The right of withdrawal is excluded for customised products.
In the event of forfeiture of the right of withdrawal, lineacortesia.it will notify the customer via email.

8. Warranty

8.1 The customer acknowledges that lineacortesia.it is solely a reseller of products manufactured by third parties; therefore, the warranty on proper functioning and compliance with regulations is limited to the legal warranty provided by the manufacturer. The customer recognizes that such warranty is strictly subject to correct product use as specified in the catalogues and/or manuals provided by the manufacturer.

8.2 In case of defects, the customer must send an email to: info@lineacortesia.it describing the defect precisely and attaching photographs. This must be done within 8 days from receipt of goods for apparent defects (e.g. packaging condition, quantity, number, external features) or within 8 days from discovery for hidden defects not detectable upon delivery. The non-conformity report must clearly indicate the defective product, product code, delivery date, defect description, and must include a copy of the delivery document. After these deadlines, no claim will be accepted.

8.3 The reported products must be promptly sent by the customer, at their own expense, to lineacortesia.it, which will forward them to the manufacturer in case of manufacturing defects. The manufacturer, after verification, will repair or replace the product.

8.4 lineacortesia.it does not guarantee that the products are suitable for the customer’s specific needs, even if consultancy was provided. Such consultancy is purely indicative and cannot result in liability for lineacortesia.it.

8.5 Except in cases of wilful misconduct or gross negligence, any contractual or non-contractual liability is expressly excluded, including for direct, indirect or consequential damages, or loss of production.

8.6 lineacortesia.it is not liable for damages caused by improper use, incorrect maintenance, incorrect installation, tampering or negligence attributable to the customer.

8.7 In any case, lineacortesia.it cannot be held liable for damages exceeding the amount paid for the specific supply.

9. Complaints – Applicable Law and Jurisdiction

9.1 The sales contract between lineacortesia.it and the customer is concluded in Italy and governed by Italian law.

9.2 Any dispute arising from or related to the contract shall be resolved, if possible, through amicable negotiation. The customer must submit a detailed written complaint describing the facts and stating their requests.

If negotiation fails, the parties agree to submit the dispute to the Mediation Body of the Chamber of Commerce of Padua.

If mediation is unsuccessful, the competent court shall be that of Padua.
